Pedestrian Accidents in California

There are laws that are set up to protect pedestrians that motorists must adhere to.  The laws require that drivers slow down to reasonable speeds or to stop to let pedestrians cross the streets.  This is required even in a mark and unmarked crosswalk areas.  The investigators that are looking into this crash are still trying to determine if the injured victim was in a safe area on the side of the road when the incident occurred.  Police will investigate all of the facts surrounding this accident.

They will examine the vehicles that were involved in the collision, look at the accident scene pictures and investigate any other factors that may have contributed to the crash.  They will also be checking to see if any of the drivers were impaired, reckless or distracted driving at the time that the accident occurred.  Upon completion of their investigation, the injured victims may have the right to file a claim for their injuries and losses.

Pedestrian accidents involve some of the most serious injuries.  This is because pedestrians have no protection from the massive vehicles that they share the roadways with.  The Governors Highway Safety Association estimates that 23% of traffic accident deaths in the state of California involve a pedestrian.  This number is far higher than the national average.  Pedestrian accidents are actually on the rise in California in recent years.
